Read about success stories regarding implementation of non-smoking bylaws in British Columbia condominium complexes:

In October 2006, the developer, Wedgewood Marcon Homes Ltd. announced that the Envy condominium complex located in North Vancouver was Canada’s first entirely smoke-free condominium development. The North Vancouver Envy condo building is LEED certified, and is leading the way in providing environmentally friendly living in the multi-housing sector.

Verdant condominiums were developed through a partnership between SFU Community Trust and Vancity Enterprises Ltd. designed to create affordable family housing within the UniverCity community. The complex includes 60 town homes, in an environmentally efficient building, designed to reduce its environmental impact wherever possible.

The strata corporation recently created a non-smoking bylaw that would ban smoking in the common property, limited common property (balconies and patios) and in strata lots. The Bylaw exempted owners residing in the complex at the time the bylaw was passed.

The Bylaw also includes a caveat that exempted owners from the bylaw are still subject to the common law of nuisance (with regard to migrating second-hand smoke), as well as other bylaws including those about causing a nuisance or hazard to another person and unreasonably interfering with the rights of another person to use and enjoy the common property, common assets or another strata lot.
